Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and Majar, Switzerland (“we”, “us”), the publisher of the Perfect Photos app (the “App”). By downloading or using the App you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.

You must be at least 13 years old, or the age of digital consent where you live, to use the App. If you use the App on behalf of someone else, you confirm that you are allowed to do so.

2. The App

Perfect Photos is a photo gallery for iPhone and iPad that browses, searches, organizes and edits the photos and videos you allow it to access, and that offers an optional paid feature, Remaster, which produces a professionally finished version of a photo you choose using artificial intelligence. Browsing, searching and organizing are free. Remaster requires an active subscription or credits (section 4).

We grant you a personal, non‑exclusive, non‑transferable, revocable licence to install and use the App on Apple devices that you own or control, in accordance with these Terms and the App Store rules.

3. Remaster and AI‑generated results

A remaster is generated by an AI model from the photo you select and the mode, look and direction you choose. Because it is generated rather than adjusted pixel by pixel, you should understand and accept the following:

• Results vary. Some photos improve a great deal, some only a little, and occasionally a result will not be to your taste. Examples shown in the App, on this website or in the App Store are illustrative and are not a promise about any particular photo.
• Details can change. A remaster keeps the framing and the moment, but fine details, textures, text, faces and objects can be rendered differently from the original, and clearly accidental clutter may be removed. Compare with your original before you share or rely on a result, in particular where accuracy matters.
• Your original is kept. A remaster is stored as a separate version. The App never alters the original in your Photos library; a copy is added to Photos only when you choose Save Copy.
• Processing may be refused. A request may be rejected by automated safety systems, or may fail for technical reasons. Refused or failed requests do not use a credit.

4. Subscriptions, free trial and credits

Remaster is offered through Apple’s in‑app purchase system on the following terms. Prices are shown in the App for your region before you buy.

• Credits. One successful remaster uses one credit. Upscaling a photo to 8 megapixels uses two credits, except on Pro where it uses one. Failed, refused or expired remasters never use a credit.
• Allowance. A subscription allowance is available for each month of the plan, including on yearly plans, resets at the start of each monthly period, and does not roll over. Pack credits never expire, work with or without a subscription, and are used only after the current month’s subscription allowance is exhausted.
• Free trial. New subscribers receive a 3‑day free trial that includes 5 remasters. You will not be charged until the trial ends. If you cancel before the end of the trial, nothing is charged. After the trial the full allowance of the plan you chose applies. One trial per Apple Account.
• Renewal and cancellation. Subscriptions renew automatically at the price shown unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple Account’s subscription settings. Deleting the App does not cancel a subscription. Unused allowance is not refunded on cancellation.
• Changing plans. You may upgrade, downgrade or switch between monthly and yearly in the App Store; Apple’s proration rules apply.
• Refunds. Payments are processed by Apple and refunds are governed by Apple’s policies; request them through Apple. If Apple refunds or revokes a purchase, the corresponding access or unspent credits are removed. Delivered remasters remain on your device.

5. Your content

Your photos are yours. You keep all rights to the photos you bring to the App and to the remastered versions that are generated for you. We claim no ownership of either.

So that we can provide Remaster, you grant us and our processing partner a limited, non‑exclusive licence to receive, process and transmit the photos you choose to remaster, solely to generate and deliver the result to you, as described in the Privacy Policy. This licence ends when the result has been delivered and our temporary copy has been deleted.

You are responsible for the photos you choose to remaster. You confirm that you have the right to use them and that they do not infringe anyone’s rights, and that you will not remaster content that is unlawful, that sexualizes minors, that is intended to harass, deceive or defame, or that you are not allowed to process.

6. Acceptable use

You agree not to:

• use the App or our service for anything unlawful, or in breach of Apple’s App Store terms;
• attempt to bypass purchase verification, credit limits, rate limits or safety systems, or use the service through anything other than the App;
• reverse engineer, copy or resell the App or our service, except where the law expressly allows it;
• present a remastered image as an unaltered photograph where that would mislead, for example as evidence, in journalism, or in a legal or official context.

We may suspend or limit access for abuse, and may refuse requests our safety systems flag.

7. Privacy

Our Privacy Policy explains what is sent when you remaster, what we keep and for how long, and your rights. It forms part of these Terms.

8. Intellectual property

The App, its design, its name and its icon are ours or our licensors’ and are protected by copyright, trademark and other laws. Nothing in these Terms transfers them to you. Perfect Photos is not affiliated with or endorsed by Apple Inc.; Apple, iPhone, iPad, Photos and App Store are trademarks of Apple Inc.

9. Availability and changes to the service

We aim to keep Remaster available, but it depends on third‑party providers and may be interrupted, slowed or changed. We may modify, add or withdraw features, modes and looks, and may change prices for future periods with notice through the App Store. If we withdraw Remaster entirely, we will make reasonable arrangements for unused pack credits.

10. Disclaimers

The App and Remaster are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non‑infringement, and we do not warrant that results will meet your expectations or that the service will be uninterrupted or error‑free. Nothing in these Terms limits the statutory rights you have as a consumer where you live.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of data, or loss of profits arising from your use of the App, and our total liability for any claim relating to the App is limited to the amount you paid us through the App in the 12 months before the claim. This does not exclude liability for death or personal injury caused by negligence, for fraud, or for anything that cannot be excluded by law.

12. Termination

You can stop using the App at any time by deleting it, and cancel any subscription in your Apple Account settings. We may end or suspend your access if you materially breach these Terms. Sections 5, 8, 10, 11 and 14 survive termination.

13. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Apple’s standard Licensed Application End User License Agreement applies to the extent it is not inconsistent with these Terms, and Apple and its subsidiaries are third‑party beneficiaries of these Terms with the right to enforce them against you.

14. Governing law

These Terms are governed by Swiss law, excluding its conflict‑of‑law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live. Disputes will be brought before the ordinary courts at our domicile in Switzerland; if you are a consumer, you may also bring a claim before the courts where you live, and claims against you as a consumer can be brought only there.

15. Changes to these Terms

We may update these Terms. Material changes will be announced in the App or on this page before they take effect, and the effective date above will be updated. Continued use after that date means you accept the updated Terms.
